  1. This service (“Service”) is provided by the Queensland Department of Transport and Main Roads (“the Department”).
  2. By utilising this Service you accept these Terms and Conditions. Please read these terms and conditions carefully as they govern the use of the Service by you (“the User”). If the User does not agree to these Terms and Conditions, then the User should not use the Service. The Department reserves the right to update these Terms and Conditions, without notice, so the User should check these Terms and Conditions each time the User uses the Service.
  3. In using this Service, the User acknowledges and agrees;
    1. the Service is provided on an “as is” and “as available” basis, and to the extent permitted by law, without any representations or warranties of any kind (whether express or implied), and the User uses the Service at their own risk; and
    2. the Service may not be uninterrupted or error free. There could also be viruses, worms and hacking and other harmful applications that may be transmitted through the Service, and the Department takes no responsibility for any damage caused as a result.
  4. The Service is provided for limited personal, non-commercial use.
  5. The Department reserves the right to terminate, or suspend the User’s use of the Service, including as a result of breaching these Terms and Conditions.
  6. To the extent permitted by law, the Department and its respective officers, employees, directors, contractors and agents exclude any liability for any loss, costs or damages of any kind whatsoever arising out of the User’s use of the Service.
  7. The User will indemnify and keep indemnified the Department including its officers, employees, directors, contractors (“those Indemnified”) harmless from and against loss, damages, claims, costs or proceedings that those Indemnified may suffer in connection with the User’s use of the Service or as a result of the User breaching these Terms and Conditions.
  8. Users agree that they are fully responsible for any materials they submit via the Service including but not limited to comments, recordings and images (“Content”). The Department shall not be liable in any way for such Content to the full extent permitted by law. The Department may remove or decline to publish any Content without notice for any reason whatsoever. Users warrant and agree that:
    1. they will not submit any Content that is unlawful or fraudulent, or that the Department may deem in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
    2. their Content shall not contain viruses or cause injury or harm to any person or entity;
    3. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
    4. they will obtain full prior consent from any person who has jointly created or has any rights in the Content to the uses contemplated by these Terms and Conditions, and the Content does not infringe the rights of any third party;
    5. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
    6. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
  9. As a collection of using the Service, each licenses and grants the Department, its affiliates and sub-licensees a non-exclusive, royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display their Content for any purpose, including but not limited to future promotional, marketing or publicity purposes, in any media, without compensation, restriction on use, attribution or liability.
  10. Any cost associated with accessing the Service is the User’s responsibility and is dependent on the Internet service/telco provider used.
